Membership Rules
AssetFair™ enables rating of its members by other users who have had experience with these members and/or their listed products. Your performance will be judged by promptness of communications, accuracy of listing information etc. where the other members will rely on your abiding by AssetFair Rules.
Observing AssetFair Rules and Use Guidelines creates a platform of common understanding between the users. Ignoring the Rules and Guidelines may negatively impact your ability to communicate with other members and consummate exchange or sale transactions.
1. Registration and Use
Membership in AssetFair ™ is FREE. When you sign up, you will be asked to review and consent to the Terms of Use and Privacy Policy. It is suggested that you enter your billing and payment information, although this data will not be needed until you list an asset and/or debt, which is subject to charge (see List Your Asset for current listing rates). Your Private Information shall be protected according to the published Privacy Policy.
Once you have registered, you will be able to search for assets (posted and wanted) using search filters, store your favorites, ask questions of owners, find out about exchange tools and enjoy other features of AssetFair™, all free. Posting an item for exchange is subject to charge.
2. Product Listing
You can list any asset, except of those explicitly forbidden under the Terms of Use, as long as its value, by your estimate, exceeds US $3,000 or its equivalent. You may list only those assets that you own or that you are authorized to list and/or represent under a written consent from the owner.
Current charge per each listing on AssetFair™ ranges from $7.50 to $15.00, subject to change. Same fees apply to TradeYourDebt™ listings where you will be asked to post an asset in exchange for a debt relief. If your listing qualifies for 3D-Exchange, there is no surcharge for participation.
When listing a product on AssetFair™, either asset or debt, you will be guided by info boxes explaining how to use the fields in the listing menu. Use good faith in assessing values and providing descriptions. The program will compute values such as Asset Value or Exchangeable Equity (see Help or FAQs for definitions).
3. Offers and Cash Bids
As a registered user (or Member) of AssetFair™, you are allowed to make offers and cash bids on listed assets. When you locate an asset of your interest, you can bid on it by using the prompts on Asset Detail.
To Make an Offer, you are supposed to use one of your listed assets. If you do not have any active listings, you will be prompted to List New Asset. If you offer an asset of higher or lower Exchangeable Equity, the Make an Offer menu will provide options how to settle for the difference.
When you make a Cash Bid, it will be compared to the Cash Reserve the owner has set for the listed asset. You will be prompted when your bid is below the owner’s minimum required as Cash Reserve.
You can also contact the owner by using the Ask Owner a Question field.
4. Managing Your Account
You can manage your listings, offers and settings in My Account menu. In the Manage My Listings, you can view, edit or delete any of your current listings. You can also view Matches, i.e. the database-generated listings most closely matching your stated exchange preferences.
If you receive any offer or a cash bid, it will appear on the Asset screen under Manage My Listings for each of your assets. You will be also notified of the offer by email, at the address you have registered. As an AssetFair member in good standing, you have 5 business days to respond to any offer received (select Accept, Consider or Dismiss in the View Offer detail).
If you receive a cash bid, it should be of a higher value than the Cash Reserve you have stated in your listing entry (AssetFair will reject, on your behalf, any cash bids lower than your Cash Reserve). You are supposed to accept such bid and negotiate a practical execution of the sale of your asset for the offered cash amount. Your failure to accept a cash bid exceeding your Cash Reserve may result in negative rating and possible suspension from AssetFair™ membership.
5. Using Tools
To facilitate an actual exchange or sale of assets, AssetFair™ is offering various tools, from a sample of an Exchange Contract to legal, escrow and other services (see the Tools menu). AssetFair™ allows providers of the Tools to post their services on AssetFair website for your convenience. Providers of these services are third parties and the Owners of ASSETFAIR DO NOT ENDORSE ANY OF THE SERVICES OFFERED BY THIRD PARTIES. AssetFair™ are not liable for any damage, material or immaterial, which may be caused to any Member by using or interpreting the services offered by providers of Tools or any advertisers on AssetFair website.
6. Communications
AssetFair™ allows communications between its members using the Message, Contact Owner, Respond and other fields. Correspondence on AssetFair between members is confidential and the contents will not be displayed to other members or third parties.
Although new AssetFair™ members generally subscribe under their e-mail address login name, AssetFair™ will not release your contact address without your consent. You can manage disclosure of your contact address to other AssetFair™ members in My Account – My Settings.
When a member of AssetFair.com makes an offer or a cash bid on your listed asset, you will be notified on AssetFair.com and you will also receive a message at your registered email address. If you do not want to receive offer notifications by email, you can indicate so at Manage My Settings. Thorugh the same menu, you can also opt out from receiving information material from AssetFair.com.
7. Transactions
AssetFair™ is a posting platform only. AssetFair™ provides a forum for independent third parties to post items they wish to barter. AssetFair™ does not participate, in any way, in the actual barter or sale transaction. AssetFair™ does not charge a commission, or any other fee, in association with the consummation of a barter or sale transaction.
The purpose of AssetFair™ website is to locate parties interested and willing to buy, acquire in exchange or refinance assets listed by AssetFair™ members. Making an offer on AssetFair™ or accepting an offer on AssetFair™ is a commitment by the member to work with the other party in diligence in order to consummate the transaction on agreed terms.
AssetFair provides its users with helpful hints and suggestions how to execute a barter transaction, providing a sample exchange contract, an addendum to listing agreements for real estate professionals, showing leads to escrow services, title insurance, transportation companies, and other professional services. AssetFair™ is not affiliated with any of those companies. All materials and information provided need to be verified to suit individual needs. Before consummating any barter transaction, AssetFair™ strongly recommends that all its users consult with their tax, financial, legal, or other qualified advisors.
